BEETROOT BLUE USER TERMS AND CONDITIONS
Beetroot Blue is the on-line store owned and operated by Heritage Portfolio Limited ("Beetroot Blue ") on the Internet. Access to the Beetroot Blue site is subject to registration and the following terms and conditions. These terms and conditions will come into effect when you register with us.
1. Registration
1.1 You are registering as a company user of Beetroot Blue. Access is via your user name and password, which is personal to you. You must therefore not allow your user name and password to be used by anyone else, and must not permit or assist anyone who is not a registered user to gain access to any part of Beetroot Blue. You must also notify us immediately if a third party obtains your user name and/or password or email address by emailing us via enquiries@beetrootblue.com
You can change your password at anytime by clicking the “Change Password” button found on the "My Details” page of the Beetroot Blue site.
2. Privacy
2.1 Beetroot Blue is committed to protecting your privacy. This section explains our Privacy Policy and provides options to let you choose how data about you is used. You can always review this information and change your preferences at any time in the future by contacting our Customer Services team at enquiries@beetrootblue.com
2.2 We hold the information that you give us when you sign-up to use the site.
We use this information to process your order and to save you from re-entering the same information every time you use the service.
We monitor purchasing behaviour to ensure our product and service offerings are optimised. Site traffic is monitored in order to improve the future design of the site.
We maintain your order history so you can view your current and previous orders.
Our operating system automatically identifies your IP address and what technology you are using to view the site. This helps us to diagnose problems with infrastructure and improve the service available to companies and users.
Additionally, some of our web pages may contain “cookies”, which are data that may be sent to your web browser and stored on your computer. This allows our server to “recognise” you when you visit our web site in the future. Most web browsers can be configured to not accept cookies, or to notify you if a cookie is sent to you.
Beetroot Blue will not sell, rent or otherwise make available your personally identifiable information to any other organisation unless that is done as part of a sale or transfer of our assets or business.
3. Security
The security of your information is of the utmost importance to us.
Servers containing sensitive information are not available to the public Internet and all our servers are located in a secure area within a secure data centre. We also have strict privacy protection protocols in place that prevent unauthorised employee access to customer data.
Where data security is of vital importance (accepting credit card payments) industry standard HTTPS data encryption is used. This ensures that your information is secure.
Our system should work through any proxy server, web cache server or ICSA certified firewall.
4. Making a purchase
4.1 To make a purchase, simply browse the Beetroot Blue site and click on any items that you wish to add to your order. After you have finished your selection, please click on "proceed to check out" and you will be asked for a few details.
4.2 There is a daily cut-off time for orders. This is shown on the opening screen. No new orders can be accepted after this time. Any cancellations or amendments to an order must be made by calling 0131 555 8474 by 2pm the day before the date. We do not accept same day cancellations or amendments.
4.3 Any order you make for products from Beetroot Blue is an offer by you to purchase such products (subject to these terms and conditions), and acceptance of any order is at Beetroot Blue's sole discretion. An order is deemed to have been accepted by Beetroot Blue only when you receive email confirmation to this effect. Once we have accepted your order, there may be occasions where, for quality reasons or for other reasons beyond our control, it will not be possible to complete your order in full. In such cases, we will contact you and ask you to amend your order. Should you have any difficulty in placing your order on-line ring our helpline on 0131 555 8474.
5. Price and Payment
5.1 The price will be as set out in Beetroot Blue 's published price list (shown on the Beetroot Blue site), current at the date of order of the products.
5.2 Price and availability information is subject to change without notice. We accept payment on-line by most leading credit and debit cards including Visa, MasterCard, Switch and Delta. Payment will be charged against your card at the time of order.
5.3 If your company has entered into an agreement with Beetroot Blue to the effect that it will pay for your order then we will arrange payment directly with your company.
5.4 For Credit Accounts, invoices are sent weekly and are payable within 14 days from the date of receipt of the invoice by Direct Debit
5.5 Beetroot Blue reserves the right in its sole discretion to accept or refuse any credit account application and to terminate any such account at any time and need not give any reason for any such decision.
5.6 All prices displayed on the Beetroot Blue web site include VAT, at the current rate, where applicable. All invoices have full VAT breakdown for your information and records.
6. Delivery
6.1 Products will be delivered to the collection point nominated by yourself at the time of making the order. Customers may change their nominated collection point when placing an order (or by amending their order providing this is done before the cut-off time).
6.2 All deliveries must be checked and signed for by an approved representative of the customer at the time of delivery. A Signature will be deemed to constitute acceptance of a complete order.
6.3 If any part of an order is found to be missing (or is rejected) on delivery, the customer must inform Beetroot Blue immediately by calling our help-line on 0131 555 8474.
7.Terms of Supply
7.1 Beetroot Blue food is supplied strictly for direct customer use. Under no circumstances is our food to be re-sold to a third party or offered at subsidised or inflated rates to a third party. This restriction also applies to in-house catering arrangements where Contract Caterers are ordering on behalf of clients.
7.2 Customers will comply with any instructions and recommendations of Beetroot Blue in relation to the storage and use of the products (for example and without limitation, use by dates).
8. Liability
8.1 The liability of Beetroot Blue in contract, tort (including, without limitation, negligence) or otherwise in respect of any products delivered or otherwise in connection with an order or for any loss, injury or damage attributable directly or indirectly thereto will at the sole option of Beetroot Blue, be limited to: (a) delivering replacement products (at Beetroot Blue's expense); or (b) refunding any sums paid to Beetroot Blue for the products.
8.2 Beetroot Blue will not be liable (whether or not caused by Beetroot Blue 's negligence) for any loss of profit or goodwill or opportunity or reputation suffered or incurred by or any third party, nor for any indirect or consequential loss.
8.3 Beetroot Blue will not be liable for any loss, injury or damage attributable directly or indirectly to any use of or inability to use the Beetroot Blue website by you including (but not by way of limitation) any inaccessibility or malfunctioning of the website or any viruses passed to your computer from the Beetroot Blue website.
8.4 Nothing in these terms will limit or exclude the liability of Beetroot Blue for death or personal injury caused by negligence on its part and nothing in these terms will affect your statutory rights.
9. Termination
9.1 You can withdraw your registration by emailing the helpdesk at sales@Beetrootblue.com
9.2 We reserve the right to terminate your access to Beetroot Blue immediately without notifying you in advance should you not operate your account in line with these terms and conditions.
10. Use of material appearing on the Beetroot Blue Site
All rights in the site design, computer codes, text, graphics and other content, interfaces, and the selection and arrangements thereof (the "Materials") belong to Beetroot Blue or its licensors. You may print or download portions of this site and make copies of these for your own personal use only. Any other use (including without limitation any further reproduction, storage or transmission to anyone) of any Materials without our prior written permission is strictly prohibited.

12. Variation
12.1 Beetroot Blue reserves the right to amend the terms of this Agreement from time to time. Your continued use of any part of the Beetroot Blue site after any such amendment will constitute your acceptance of the amendment or amendments concerned. You should therefore regularly visit these terms and conditions to ensure that you keep up to date with your rights and obligations under this Agreement. If any such amendments are considered in the reasonable opinion of Beetroot Blue to be material, notice of the amendments will be emailed to all registered users of the Beetroot Blue site at their registered email address.
12.2 If you do not wish to accept an amendment you should immediately withdraw your registration to the Beetroot Blue site.
13. Access/Force Majeure
13.1 Although we will aim to provide uninterrupted access to the Beetroot Blue site, we cannot guarantee this. We accept no responsibility or liability for any interruption or delay which may occur to anyone visiting or wishing to visit the Beetroot Blue site.
13.2 In the event we cannot fulfil obligations to you under this agreement due to any event beyond our reasonable control, we will notify you and we will be relieved of our obligations to you under these terms and conditions to the extent such performance is hindered by such an event.
14. Jurisdiction
This Agreement is governed by Scottish law and both we and you agree to submit to the exclusive jurisdiction of the Scottish courts.
